My point is, what you call IOD supporters "threats of lawsuits", are really no more threatening than NeuStar's proclivity to gear up for lawsuits by extending indemnification to ICANN.  NeuStar made a statement, and wanted that statement posted, via their application. Get it?  And to be fair, yes, maybe 1 or 2 IOD supporters threaten lawsuits, while many more merely state they recognize an inevitability, should a "fair and open" process turn out to be a sham.
