The decision is a ruling on SUMMARY JUDGEMENT - specifically that EVEN IF ALL THE ALLEGATIONS WERE TRUE that IOD has no legitimate TRADEMARK CLAIM to .web. That is an appropriate and welcome ruling in my humble opinion. The ruling goes on to explain HOW and WHEN domain names ARE legitimately used as trademarks and references the current governing document regarding this matter per USPTO.
This ruling is very specific and technical. It has no relevance on any other claims or issues relating to the primacy of IOD's claim as a pioneer of the .web registry.
I hope that clears this up.
