Please read the application by IOD. Names like Disney.web, CocaCola.web, GeneralMotors.web etc. Would have no problem getting their trademarks. IOD would give any registrant a one for one exchange if they hold a trademarked name. I think people whom register these names are foolish and deserve to loose the names to the TM holder.
Trademark holders must protect their rights in all venues, not just domain names. It's not the responsability of the registrar to be judge and jury in TM disputes. If Afilias is chosen there will be just as many TM disputes if not more. There will also be cybersquatters at Afilias only many will be insiders and the disputes will be faught long and hard. WE CAN NOT TRUST AFILIAS!
