I do not speak for Chris, but as a registrant with IOD since 1996, I can say that when I registered my .web domain names there WERE NO OTHER OPTIONS.... ICANN or IANA at the time had not firmly settled what they would do, Jon's untimely demise set the timeline back even further.  What I took the regulation to mean was simply this:
If you want to support a real viable alternative to the monoply of NSI then it will cost - at the time the going rate was $35 (how I miss the days of FREE registration- but that is a separate matter).  Clearly, things might change and if they did, we would lose our money.  This is a policy that has been in place for YEARS. 

I think it is unfair to Chris and his company to paint this as a late added feature ignoring the late comers to the scene.  It also betrays a lack of appreciation for the historical record.
