        URLMerchant, Inc. supports Image Online Design's (IOD) application for the .WEB TLD.  We believe their registry is viable, authorized and legally first in line for approval.  We feel IOD has been more than accomodating to ICANN by following their new TLD application procedure and submitting their application, especially considering that IOD's position is that it has already been *granted* the rights to run the .WEB registry by ICANN's predecessor IANA.  As you all know ICANN assumed IANA's charter and the perks, benefits and responsibilities thereof.  To simply disregard the obligation to IOD would be fiscally irresponsible.

URLMerchant would be prepared to join or financially aid a suit against ICANN should ICANN default on previous agreements by granting .WEB registry rights to an entity other than IOD.  In that event, things like the apparent impropriety that currently exists within the organization, breach of contract (treble damages), tortious interference with advantageous business relationships, etc. all seem like things the plaintiff's counsel would examine and we would be prepared to support.

URLMerchant has registered (not-preregistered) numerous .WEB names through IOD and will vigorously fight to protect the validity of those registrations.  While the fees represent an small sum to our organization, we believe the registrations are valid and that the registry should finally be granted ICANN blessing.

It is our belief that ICANN won't have to worry about how to spend their recent financial windfall from application fees should they decide to award .WEB to someone other than IOD.  We will help them spend it.
